Terms of Engagement

Effective: March 2025 · Coimbatore Jurisdiction

All quotes, earthmoving subcontracts, machine dry-hire arrangements, and civil site preparations undertaken by KRS Earth Movers Co. Pvt. Ltd. are governed by the following operational terms.

1. Bidding & Quote Validity

All official site preparing, land clearing, and bulk excavation quotes generated by our operations team are valid for exactly 30 calendar days from the date of issuance. Bids submitted for government program tenders (PWD/NHAI) are bound by the validity timelines declared in the respective tender notifications.

2. Geotechnical Conditions & Rate Adjustments

Standard cubic-metre excavation rates assume typical geological profiles (cohesive red loam, dry gravel, Moorum, or standard soft clays) as identified in initial site borelogs.

Important Notice The discovery of unchartered hard granite, heavy boulders, ancient masonry structures, buried concrete foundations, or active water seepage requiring continuous hydraulic breakers or sheet-pile shoring will result in an immediate suspension of digging. Work will resume only after a revised rate analysis is agreed upon in writing.

3. Site Access & Regulatory Clearances

The project client is solely responsible for ensuring clear, load-bearing access roads for our heavy low-bed trailer transports to haul excavators and rollers onto the plot. The client must secure all local boundary clearances, tree-felling approvals, groundwater dewatering permits, and local panchayat clearances prior to the scheduled mobilization date.

4. Machinery Dry-Hire & Wet-Hire Terms

For equipment rental engagements (dry-hire or wet-hire):

Shift Hours: Standard shifts are calculated on an 8-hour engine-on cycle. Overtime is billed hourly.
Fuel & Consumables: Wet-hire includes diesel and operator. Dry-hire places the responsibility of clean, adulteration-free diesel on the client.
Maintenance Downtime: We reserve the right to halt operations for mandatory periodic service checks (hydraulic oil filter changes every 250 hours) without rental penalty.

5. Payment Schedules & Milestones

Our payment terms are structured as follows:

A mobilization advance of 15% is required before heavy machines are dispatched to the site.
Subsequent billing cycles are processed weekly or bi-weekly based on actual field measurements (quantity of cubic metres moved/compacted) signed off by both site representatives.
Invoices are due under Net-30 terms. Overdue payments will accrue interest at a rate of 1.5% per month starting from the 31st day.

6. Jurisdiction & Disputes

Any operational disputes, disagreements on site volume calculations, or contract breaches are subject to exclusive arbitration within the legal jurisdiction of courts in Coimbatore, Tamil Nadu, India.
